ATLANTA (AP) — A bill was vetoed on Friday night in the Georgia Senate that would have permitted citizens to take legal action against municipal authorities for implementing local firearms regulations.
The legislation, advocated by its backers as a measure to prevent local governments from infringing upon individuals' firearm liberties, was approved by the House earlier on Friday, with the Senate anticipated to provide the necessary final endorsement. However, the legislative body concluded its concluding session prematurely without casting a vote on the bill, rendering it inactive for now until possibly being reconsidered in the following year when the Senate might revisit it.
Bill 204 proposed allowing individuals to take legal action against local governments if they felt aggrieved due to a regulation conflicting with their firearm rights as established by state legislation, and permits them to claim reimbursement for certain losses incurred.
Trenton Republican Sen. Colton Moore suggested the initial approach to block firearm safety regulations like one in Savannah However, Moore stated that he now opposes this measure partly due to the fact that the maximum compensation an individual can get is $25,000 rather than $50,000. The initiative aims to penalize those who store firearms in unsecured vehicles.
Democrats—including those who claim ownership of firearms—stated that the legislation could impede local authorities aiming to safeguard citizens against avoidable gun-related crimes.
The law was also enacted several months following this event. mass shooting At Apalachee High School near Atlanta, a 14-year-old boy is alleged to have killed two teachers and two students and injured multiple others on September 4th using a gun obtained from his dad.
The Apalachee families have repeatedly approached you, requesting sensible firearm storage legislation," stated Atlanta Democrat Shea Roberts. "Yet our response is a bill that prohibits such safety measures? SB 204 feels like an insult to these families. But why? Is it to penalize Savannah for attempting to reduce gun theft and violence?
Republican Representative Alan Powell expressed disappointment over the Democrats raising the issue of the shooting, stating that he believes it has no connection to enforcing state gun legislation.
"This statement affirms our steadfast commitment to the Second Amendment, and this bill guarantees that residents of Georgia are safeguarded against excessive governmental intervention," stated Republican House Majority Leader Chuck Efstration.
Democrats similarly charged Republicans with "highjacking" legislation. This provision was later attached to an unrelated Senate Democratic bill.
Another proposal from the Democrats would have established a $300 tax credit For secure storage devices and guidelines, it garnered backing from both parties in previous years. Additionally, Democrats aimed to criminalize adults allowing children access to firearms unless stored securely.
Rather, a provision was included in House Bill 79 to provide a $300 tax credit for individuals who enroll in an in-person class about responsible firearm handling. This bill would also establish a four-day sales tax exemption in October for firearms and related items. However, it failed to receive the necessary final vote in the Senate.
