SAN DIEGO ( Border Report — Lawmakers in California are currently developing legislation aimed at limiting federal agents' ability to enter public schools and interact with students when they are conducting immigration enforcement activities.
According to Senate Bill 48 As stated by him, "This provision would prevent school districts, county offices of education, or charter schools along with their staff members from allowing immigration authorities to enter the school premises, bringing students forward for interrogation within the school grounds, or permitting any type of search conducted by these authorities at a school location, except when they present a legitimate judicial warrant or court order."
On Wednesday, the legislation, proposed by officials at the state level, was presented as a bill. Sen. Lena Gonzalez , D-Long Beach, received approval from the Senate’s Education Committee with a 6-1 vote.
The U.S. Supreme Court has consistently ruled that the Constitution ensures a right to education irrespective of one’s immigration status," stated Gonzalez via an official release. "Until recently, the federal government regarded such areas as schools as protected zones. However, conducting immigration activities close to educational institutions can deter students from attending school regularly, exacerbate academic setbacks, and negatively impact their psychological well-being.
Currently, schools in California are not allowed to gather any information about students' or their families' immigration status. Additionally, they cannot release any student records without obtaining parental consent or as directed by a court order.
If enacted, SB 48 would make it significantly more difficult for federal officials to obtain any details or entry regarding students.
Over the next few weeks, Senate Bill 48 will be presented to California’s entire senate for a vote that necessitates a two-thirds majority.
Once approved, the measure will go to the state Assembly for them to determine whether it reaches Governor Gavin Newsom’s desk.
